FRA Administrator John Riley said the case illustrated the importance of urine and blood tests being conducted on members of train crews involved in major accidents.
The difference is that the advocacy group includes all accidents involving a train carrying toxic materials and the FRA and AAR point only to accidents where hazardous materials were released.
It gives the FRA power, for the first time in its 21-year history, to suspend and fine railroad employees.
However, it said that "during the assessment process, whenever the FRA made Conrail aware of what the agency believes were issues that needed attention, Conrail investigated and where appropriate, took corrective action."

The FRA said that tests on his body disclosed traces of marijuana in the blood and urine.
"Both management and those opposing management's position have demonstrated their willingness to compromise both work place and public safety when their economic interests are at stake," the FRA report said.
Faber and Torres showed traces of butalbital, a barbiturate, in their urine and blood, and Jones had traces marijuana in his, according to the FRA.
In response, FRA officials who testified at the hearing said that they were moving to resolve the issue.
Other crew members aboard the two trains tested negative, the FRA said.
